Common questions

I've been served with a notice. Do I have to leave?

Not on the date in the notice. A notice is not an eviction — only a court can order possession, and only a bailiff or High Court enforcement officer can carry it out.

The court date is next week. Is it too late to get help?

No, but act today. Possession hearings are short and preparation makes a real difference. Do not simply fail to attend.

What is a mandatory ground?

One where the court must grant possession if it is proved, with no discretion to consider your circumstances. Discretionary grounds allow the court to weigh reasonableness. Which applies changes everything about your defence.

I'm a landlord. How long does it take?

Longer than most expect — several months is common, and longer where the claim is defended. Getting the paperwork right at the outset is the single biggest factor.
