Common questions

I signed a consent form. Does that stop me claiming?

No. Consent covers the risks that were properly explained to you. If a material risk was not discussed, or the error was one no competent surgeon would make, consent is no defence.

What is a never event?

A serious, largely preventable incident that should not occur if proper safeguards are in place — wrong-site surgery, or an instrument left inside a patient. Where one has occurred, negligence is usually difficult to dispute.

Can I claim for cosmetic surgery that went wrong?

Yes, and private cosmetic work is subject to the same standards. Contractual claims may also be available alongside negligence.

The hospital has already apologised. Does that help?

It may. There is a statutory duty of candour requiring providers to be open about mistakes, and an apology is not an admission of legal liability — but the underlying investigation is often very useful.
