Common questions

How long do I have to claim?

Generally three years from the date of the accident. For children the three years runs from their eighteenth birthday. There are limited exceptions, but do not rely on them.

The other driver wasn't insured. Can I still claim?

Usually yes. The Motor Insurers’ Bureau exists to compensate people injured by uninsured and untraced drivers, though the process differs and time limits can be tighter.

Their insurer has offered me money directly. Should I accept?

Not without advice. Early offers made before your injuries have been properly assessed are very often well below what the claim is worth, and accepting closes the matter permanently.

Will I have to go to court?

The overwhelming majority of claims settle without a hearing. Court proceedings are sometimes issued to apply pressure or protect a time limit, which is not the same as going to trial.
