Common questions

How long do we have to claim?

Where the child is injured, the three year period does not begin until their eighteenth birthday, and does not apply at all if they lack capacity to conduct proceedings. A mother’s own claim is subject to the ordinary three year limit.

What is cerebral palsy worth as a claim?

Where negligence is established, awards reflect a lifetime of care, therapy, equipment and adapted accommodation, and can be very substantial. The figure reflects need, not punishment.

The hospital has done its own investigation. Do we still need a claim?

Investigations establish what happened; they do not provide funding for care. The two serve different purposes and often run alongside each other.

Is it too late if our child is already at school?

Very often not, for the reasons above. It is always worth asking rather than assuming.
