Common questions

Can I be sacked for bringing a claim?

Dismissing someone for pursuing a personal injury claim would expose your employer to a separate and serious claim. Employers are insured for accident claims, and it is the insurer, not your manager, who pays.

It was partly my fault. Can I still claim?

Often yes. Compensation can be reduced to reflect your share of responsibility rather than refused altogether. Employers frequently overstate the employee’s role in an accident.

I didn't report it at the time. Does that matter?

It makes the claim harder but not impossible. Contemporaneous medical records, witnesses and any messages you sent at the time all help.

What if my employer has gone out of business?

A claim can often still proceed against the insurer that was on risk at the time. We can trace historic employers’ liability policies.
