Common questions

Isn't professional negligence hard to prove?

It is demanding. You must show the advice fell below the standard of a reasonably competent practitioner, and that you suffered loss as a result. Being unhappy with an outcome is not enough.

Should I complain to their regulator first?

A complaint can be useful and costs nothing, but regulators generally do not award compensation for financial loss. The two routes can run in parallel.

How long do I have?

Generally six years from the negligent act, or three years from when you knew or should have known about the loss, subject to a fifteen year longstop. These rules are technical and easy to get wrong.

My solicitor made a mistake in my conveyancing.

Common examples include missed searches, defective title, unnoticed rights of way and failure to advise on planning issues. These are usually well covered by professional indemnity insurance.
