Common questions

. We never signed anything. Do I still have a contract?

Almost certainly. Contracts can be made verbally or by conduct. The difficulty is proving the terms, which is where emails, invoices and messages become important.

How long do I have to bring a claim?

Generally six years from the breach for a simple contract. Do not leave it — evidence and witnesses deteriorate long before the limitation period expires.

What can I actually recover?

Normally damages putting you in the position you would have been in had the contract been performed. Losses that were too remote, or that you failed to take reasonable steps to mitigate, are not recoverable.

Is it worth suing for a small amount?

Often not through the ordinary courts. The small claims track handles lower value disputes with limited costs recovery, meaning you generally cannot recover your legal fees — so we will tell you honestly whether it makes sense.
