Common questions

I'm being investigated but not charged. Do I need a solicitor now?

Yes, and this is the stage where advice makes the most difference. What you say in an early interview shapes everything that follows, and cases are sometimes resolved before charge.

What is the test for dishonesty?

The court considers your actual knowledge or belief as to the facts, then asks whether your conduct was dishonest by the ordinary standards of reasonable people. It is not a purely subjective test.

Can they freeze my assets?

Restraint orders can be obtained during an investigation, restricting what you can do with your property. They can be challenged and varied, including to release funds for legal representation and reasonable living expenses.

What about my professional registration?

Regulatory consequences frequently run alongside criminal proceedings and sometimes outlast them. The two need managing together, and what is said in one can be used in the other.
