Common questions

What counts as exceptional hardship?

Hardship beyond the inconvenience anyone would suffer from losing their licence. Losing your job is not automatically enough. Hardship to others — employees who would lose their jobs, dependants who would lose care — carries considerably more weight.

Will losing my job be enough?

On its own, often not. Courts hear that argument constantly. What makes a difference is the knock-on effect on other people and the absence of any alternative.

Can I use the same argument twice?

Generally not. Circumstances relied on successfully cannot normally be relied on again within three years, which makes the first argument worth preparing properly.

What if it fails?

The disqualification follows, usually six months. Because the stakes are high and the argument is one-shot, this is not a hearing to attend unprepared.
