Common questions

How early should we get advice?

At the first letter. The written response to initial allegations is what decision-makers read, and a large proportion of cases are closed or narrowed at that stage. It is far easier to get right than to correct.

Can a registration be restricted before any findings?

Yes. Interim orders can restrict or suspend practice while an investigation continues, where a regulator considers there is a risk. These hearings move quickly and are often the most urgent part of a case.

What is the business's position if an employee is referred?

Related but not identical to the individual’s. The business may have its own regulatory obligations, and there can be a conflict. Being clear from the outset who is being advised avoids a much bigger problem later.

Does an apology make things worse?

Generally not — regulators are concerned with current fitness to practise, and evidence of insight and remediation frequently improves the outcome substantially. How it is expressed matters, which is what advice is for.
