Common questions

Isn't this hard to prove?

It is demanding. You must show the advice fell below the standard of a reasonably competent practitioner, and that the failure caused your loss. A disappointing outcome is not the same as negligence, and we will tell you which you have.

What are the time limits?

Generally six years from the negligent act, or three years from when you knew or should have known of the loss, subject to a longstop. These rules are technical, frequently misunderstood, and worth checking early.

Should we complain to their regulator instead?

A complaint costs nothing and can be useful, but regulators generally do not award compensation for financial loss. The two routes can run in parallel where the sums justify it.

They've admitted the mistake. Is that enough?

It helps considerably, but you still need to prove what the mistake cost you. Causation and quantum are usually the harder half of a professional negligence claim, not liability.
