Common questions
We didn't sign anything. Is there a contract?
Very probably. Contracts can be formed verbally or by conduct, and terms about quality, care and payment are implied by law. The difficulty is evidence, which is where purchase orders, emails and invoices become important.
How long do we have?
Generally six years from the breach for a simple contract, twelve for a deed. Do not wait — witnesses move on and documents get archived long before the limitation period expires.
What if they go insolvent mid-claim?
It is a real risk and worth assessing before you spend money. A judgment against a company with no assets is worth nothing. We look at the counterparty’s financial position as part of advising whether to proceed.
Can we recover our costs?
Usually a proportion if you win, though rarely all of it. On lower value claims allocated to the small claims track, costs are generally not recoverable at all — which changes the economics entirely.
