Common questions

The Land Registry plan shows the boundary. Isn't that conclusive?

Rarely. Registered title plans show general boundaries only, and are drawn to a scale where the line itself can represent a metre or more on the ground. They are a starting point, not an answer.

Whose fence is it?

There is no reliable rule, despite what people believe about which side the posts are on. The deeds may say, and historic conveyances often do. Otherwise it may be a matter of evidence and long usage.

My neighbour has been using part of my garden for years.

They may have a claim to it through adverse possession, though the requirements for registered land are demanding. Do not let it continue while you decide.

Is it worth going to court?

Usually not, and we will tell you so. Legal costs in boundary disputes routinely exceed the value of the strip in question. Mediation and a determined boundary agreement are almost always the better route.
