Common questions

Every doctor missed it. Does that make it acceptable?

Not necessarily. The test is what a responsible body of practitioners would have done, and a widely repeated failure can still fall below that standard.

How do I prove an earlier diagnosis would have helped?

Through expert evidence on what treatment would have been available at the earlier stage and what outcome it would probably have achieved. This is often the hardest part of the case.

My relative died. Can I bring a claim?

Yes. Certain family members can bring claims on behalf of the estate and for their own dependency. Time limits apply and an inquest may run alongside.

The GP says it was a judgement call. Is that the end of it?

No. Clinical judgement is not a shield if the decision was one no reasonable practitioner would have reached on the information available.
