Common questions

Isn't it just a bad outcome?

Frequently, yes — medicine carries risk, and a poor outcome is not automatically negligence. The test is whether the care fell below the standard of a responsible body of practitioners, and whether that failing caused your injury. Both have to be proved.

How long do I have?

Generally three years from the treatment, or from when you first knew the injury was linked to it. Cases involving children or people who lack capacity are treated differently. Records are harder to obtain as time passes, so early advice matters.

Will suing affect my ongoing care?

It should not, and NHS trusts are used to claims being brought. If you are concerned about continuing under the same clinicians, that can usually be addressed.

Should I complain first?

A complaint is not required before a claim, but the response can be genuinely useful evidence. We can advise on running the two in parallel.
